These Terms of Service ("Terms") govern your use of Blue Peak Pros services and website. By engaging our services or accessing our website, you agree to these Terms.

1. Services

Blue Peak Pros provides done-for-you automation systems for home service businesses, including but not limited to: lead follow-up automation, booking calendar setup, CRM configuration, missed call text-back, review request automation, and related services (collectively, the "Services").

2. Payment Terms

  • A one-time setup fee is due at the time of purchase before the build begins.
  • Monthly subscription billing begins 30 days after the setup fee is collected.
  • All payments are processed securely through Stripe.
  • Setup fees are non-refundable after the build has commenced, except as described in the Guarantee section below.

3. 30-Day Results Guarantee

If your system does not generate at least 5 additional booked appointments within your first 30 days of going live, Blue Peak Pros will continue working on your system at no additional charge until that result is achieved. This guarantee applies only when the client has provided accurate business information, connected all required integrations, and is actively receiving leads.

4. Client Responsibilities

  • Provide accurate business information, phone numbers, and access credentials necessary for setup.
  • Respond to onboarding communications in a timely manner.
  • Ensure you have the legal right to contact the leads entered into the system.
  • Comply with all applicable laws regarding SMS and email marketing, including the TCPA and CAN-SPAM Act.

5. SMS Messaging Program

Blue Peak Pros operates an SMS messaging program that sends transactional and promotional text messages to opted-in contacts. Message types include appointment reminders, booking confirmations, missed call follow-ups, lead follow-up sequences, and promotional offers related to Blue Peak Pros services.

Message Frequency: Message frequency varies. You may receive up to several messages per week depending on your activity and service plan.

Message and Data Rates: Message and data rates may apply. Standard carrier message and data rates may apply depending on your mobile carrier and plan. Check with your carrier for details.

How to Opt-Out: You may opt out of receiving SMS messages at any time. To stop receiving messages, text STOP to any message you receive from Blue Peak Pros. After texting STOP, you will receive one final confirmation message and will be unsubscribed. No further messages will be sent.

Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages. Blue Peak Pros is not responsible for any delays or failures in the delivery of messages caused by your mobile carrier.

Age Restriction: You must be 18 years of age or older to opt in to our SMS messaging program. By opting in, you represent and warrant that you are at least 18 years old. Our SMS program is not directed to individuals under the age of 18.

No Sharing of SMS Opt-In Data: SMS opt-in data and consent will not be shared with, sold to, or transferred to any third parties or affiliates for their own marketing purposes.

6. Acceptable Use

You agree not to use our services to send spam, harass individuals, violate any applicable law, or engage in any activity that could harm Blue Peak Pros or its reputation.

7. Cancellation

You may cancel your monthly subscription at any time with 30 days written notice sent to [email protected]. Upon cancellation, your system will be deactivated at the end of the current billing period. Your contact data will be exported and made available to you upon request.

8. Intellectual Property

All workflows, templates, and systems built by Blue Peak Pros remain the intellectual property of Blue Peak Pros. You are granted a non-exclusive license to use the system for the duration of your subscription. Upon cancellation, that license terminates.

9. Limitation of Liability

Blue Peak Pros shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services, including lost revenue or missed leads. Our total liability shall not exceed the amount paid by you in the 30 days preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Blue Peak Pros from any claims, damages, or expenses arising from your use of the services or violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of Illinois. Any disputes shall be resolved in the courts of Illinois.

12. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
